Objection to court cost assessment: limitation of § 66 GKG review to calculation errors, not merits of cost liability
Legislator-Zusammenfassung
KI-generiertThe Bundesgerichtshof (8th Civil Senate, deciding as a single judge) dismissed the defendant's objection to the court's cost assessment, thereby upholding the original decision. The dispute concerned a procedural challenge where the defendant had previously filed an unsuccessful *Rechtsbeschwerde* and a subsequent *Anhörungsrüge* (complaint against non-hearing), both of which were rejected with costs ordered against the defendant, resulting in a billed court fee of €66. The court ruled that the defendant's subsequent letter constituted a formal *Erinnerung* under § 66 GKG, which strictly allows challenges to the calculation or validity of the cost assessment itself, not the underlying procedural merit of the cost burden. Because the fee was correctly calculated based on the applicable tariff for the *Anhörungsrüge* rejection, the objection was meritless. Consequently, no court fees are charged for the objection proceeding itself, and no out-of-pocket costs are reimbursed.
