Formal legal force of security proceedings conclusion despite failure to transition to criminal trial under § 416 StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) 3rd Criminal Senate rejected the defendant's revision as unfounded, affirming the Landgericht Kleve judgment of May 12, 2025, and ordering the defendant to bear the costs of the appellate proceedings and necessary expenses of the auxiliary plaintiff. The dispute concerned whether the lower court’s decision on specific acts originally subject to a security proceedings procedure (Sicherungsverfahren), which were independent procedural objects, was valid despite the failure to formally transition them into the criminal trial via §§ 416(1), (2) StPO. The court held that while the transition was procedurally erroneous and the court did not decide on the merits of those acts from a legal perspective, the formal legal force (Rechtskraft) of the security proceedings conclusion remained intact; consequently, continuing to process the security proceedings for transition is prohibited, and the issue of consumption of criminal prosecution (Strafklageverbrauch) for those acts did not need to be decided in this instance.

BVerfG, Beschluss vom 5. August 2009 ‒ 2 BvR 2098/08 u.a., BVerfGK 16, 98, 108; BGH, Urteile vom 29. April 1958 – 1 StR 68/58, BGHSt 11, 319, 322; vom 29.
