The Federal Court of Criminal Justice (BGH) rejected the convicted defendant's applications for a determination of the competent court under § 13a StPO and for the appointment of his counsel of choice, thereby upholding the rejection of his procedural requests. The dispute arose from the defendant's attempts to challenge the enforcement of a two-and-a-half-year custodial sentence imposed by the Stuttgart-Bad Cannstatt District Court, specifically seeking a jurisdictional ruling by the BGH regarding his "lawsuit" against the prison. The court determined that the prerequisites for a judicial forum allocation under § 13a StPO were absent because a competent court already existed within the scope of the Code of Criminal Procedure: the Karlsruhe District Court (Pforzheim branch) retained exclusive jurisdiction over execution matters under § 462a para. 1 StPO and prison law under § 110 StVollzG. Consequently, the ancillary request for the appointment of defense counsel was denied due to the lack of prospects of success for the primary application.

Volltext

BGH, Beschluss vom 4. Februar 2020 – 5 AR (VS) 89/19 Rn. 1).
