The Federal Court of Justice (6th Criminal Senate) dismissed the defendant's appeal against the total aggregate sentence as unfounded and rejected a lawyer's immediate complaint against the cost order as inadmissible, thereby confirming the lower court's conviction for embezzlement and withholding of employee contributions resulting in a total custodial sentence of three years and six months. The dispute concerned the procedural status of the defendant's legal representation in the second instance after the appellate court had previously severed part of the case and remanded it for re-evaluation of the aggregate sentence and dismissal of specific charges. The court held that the aggregate sentencing was legally correct and that the attorney, whose mandatory appointment had been explicitly limited to a single hearing date, lacked a valid power of attorney and thus acted as an unauthorized defender, making him personally liable for the costs of the complaint under § 473(1) of the Code of Criminal Procedure.

BGH, Beschluss vom 22. Juni 2011 – 2 StR 97/11; OLG Hamm, Beschluss vom 16. Mai 2012 – 3 Ws 52/12; OLG Frankfurt, Beschluss vom 11. Juni 1991 ‒ 2 Ws 79/91, NJW 1991, 3164; Meyer-Goßner/Schmitt, StPO, 67. Aufl., § 473 Rn. 8).
