Juvenile homicide conviction: pedagogical justification for imposing victim's procedural costs on minor offender
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (5th Criminal Senate) rejected the defendant's appeal and his immediate complaint, thereby upholding the underlying conviction and the order for the defendant to bear the necessary costs and expenses incurred by the counterclaim in the appellate proceedings. The dispute concerned a juvenile defendant convicted of a homicide, who challenged both the substantive verdict and the assignment of the victim’s costs under juvenile criminal law principles. Relying on § 349(2) StPO for the rejection of the appeal and §§ 472(1) StPO and 74 JGG for the costs, the court held that no legal errors detrimental to the defendant were found and that imposing the victim’s necessary expenses on a juvenile convicted of a homicide is permissible for pedagogical reasons, specifically to illustrate to the offender that their actions affect family members.

BGH, Beschluss vom 24. Oktober 2018 – 4 StR 314/18 Rn. 5 mwN).
