Admission to revision in insurance dispute and whether CJEU preliminary reference was required as a non-acte éclairé
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff’s complaint, thereby rejecting the appeal against the non-admission of a revision by the Oberlandesgericht Düsseldorf and leaving the appellate judgment in force; the plaintiff bears the costs of the proceedings, with a contested value of €95,000. The dispute involved an insurance claim where the appellant argued that the lower court was obligated to refer a legal question to the Court of Justice of the European Union (CJEU) under Article 267(3) TFEU regarding the interpretation of Union law. The BGH held that the revision was not admissible because the case lacked fundamental significance and did not require further development of the law or uniform legal application, reasoning that the CJEU had already clarified the specific legal issue in a prior judgment (Case C-821/21), thus constituting an "acte éclairé" that negated the need for a preliminary reference.
