Scope of appellate review for prior license revocations and mandatory correction of confiscation amounts in criminal judgments
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Justice (4th Senate) dismissed the defendant's appeal as unfounded, but with two specific modifications: it retained the prohibition on reissuing a driver's license imposed by a prior order while deeming the revocation of the license and confiscation of the physical permit already effective and thus unnecessary to repeat, and it corrected the judgment formula to order the confiscation of 69,945 euros; the defendant bears the costs of the appellate proceedings. The case involved a criminal appeal challenging the lower court's handling of ancillary measures related to traffic offenses and the disposition of proceeds, specifically addressing whether the revocation and confiscation of a driver's license from a previous criminal order (Strafbefehl) required a new declaration upon the entry into force of the current judgment. The court held that because the prior revocation and confiscation became legally effective immediately with the finality of that earlier order, they were considered "done" and did not require a new ruling, whereas the suspension period for reissuance remained pending and thus required a fresh formulation in the judgment; additionally, the court applied Section 354(1) of the Code of Criminal Procedure to correct the formula regarding the amount subject to confiscation.

a) die Sperre zur Wiedererteilung einer Fahrerlaubnis aus dem Strafbefehl des Amtsgerichts Hamburg-Wandsbek vom 21. Mai 2024 (728d Ds 43/24) aufrechterhalten wird. Die Aufrechterhaltung der Entziehung der Fahrerlaubnis und der Einziehung des Führerscheins entfällt;
