Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the defendant's appeal as unfounded, upholding the lower court's conviction and ordering the defendant to bear the costs of the appeal and the necessary expenses of the private prosecutor. The dispute concerned a challenge to a sexual offense conviction, where the defendant contested the constitutionality of the statutory aggravation under § 177 Abs. 2 Nr. 2 StGB. The appellate court held that the constitutional challenge was moot because the lower court's findings of fact, made without legal error, were sufficient to support the conviction for the basic offense of sexual assault under § 177 Abs. 1 StGB, as the victim had explicitly refused the sexual acts and the defendant was aware of this refusal in all instances.

Februar 2020 – 2 StR 5/20, Rn. 6). Die Nebenklägerin lehnte sexuelle Handlungen ab, was der Angeklagte in allen Fällen erkannte.
