Admission of revision for uniformity in calculating and crediting usage compensation in civil proceedings
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the appellate court's refusal to admit a revision, thereby upholding the lower court's judgment on claims for usage compensation and crediting. The dispute concerned the calculation and crediting of usage compensation in a civil matter, where the plaintiff argued that the legal issue was of fundamental significance or required reference to the European Court of Justice to ensure uniform legal application. The BGH held that the plaintiff failed to demonstrate a valid ground for admission of revision regarding the assessment and crediting of the compensation, and that no preliminary reference to the ECJ was warranted based on prior jurisprudence; consequently, the plaintiff bears the costs of the proceedings, and the appellate judgment stands.
