Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the appeals of the two accused as unfounded, thereby upholding the lower court's conviction for joint arson under § 306 Abs. 1 Nr. 6 StGB and leaving the judgment of the Leipzig Regional Court in force. The dispute centered on whether specific acts of ignition, which resulted only in minor property damage ranging from 120 to 320 euros, met the statutory threshold for the crime of arson, particularly regarding the assessment of the affected objects' value and the nature of the danger posed. The court ruled that the convictions stand regardless of the low financial damage because the factual findings demonstrated that each fire incident involved a high "Gemeingefahr" (general public danger), which is the decisive element for this offense. The key legal basis is § 306 Abs. 1 Nr. 6 StGB, interpreting the requirement of general danger as satisfied even when the material value of the destroyed items is low, as established by the BGH’s clarification on the requisite level of communal risk.

Radtke in MüKo-StGB, 4. Aufl., § 306 Rn. 22 mwN).
