Rejection of non-admission of revision for lack of fundamental significance without reference to CJEU
Legislator-Zusammenfassung
KI-generiertThe defendant's withdrawal of its appeal with leave to appeal (Revision) resulted in the declaration of loss for that legal remedy, while the plaintiff's complaint against the non-admission of the appeal was rejected because the matter lacked fundamental significance, leaving the judgment of the Schleswig-Holstein Higher Regional Court in force. The dispute concerned a civil matter where the appellant argued for a preliminary reference to the Court of Justice of the European Union, but the Federal Court of Justice held that no such reference was necessary, relying on its recent jurisprudence to conclude that the legal question did not require further development or a uniform interpretation of the law. The decisive legal basis for the rejection was § 543 Abs. 2 Satz 1 ZPO, which governs the admission of appeals based on fundamental significance and the need to ensure uniform case law.
