The Federal Court of Justice (BGH) dismissed the defendant's motion for a hearing complaint (Anhörungsrüge) against a prior panel decision, with costs borne by the defendant. The dispute concerned an appeal against the non-acceptance of a revisionary appeal, where the appellant alleged that the panel had failed to consider specific arguments regarding the merits of the non-acceptance complaint. The court found the complaint unfounded, reasoning that the panel had already fully examined and rejected the cited arguments in its initial decision; therefore, the court applied the provisions allowing for a lack of further reasoning, citing significant doubts regarding the admissibility of the hearing complaint under German civil procedure law.

Volltext

Die Anhörungsrüge gegen den Senatsbeschluss vom 5. Oktober 2022 wird auf Kosten der Beklagten zurückgewiesen.

[GRUENDE]

Senatsbeschluss vom 11. Dezember 2019 - XII ZR 18/19 - juris mwN).
