Admission of revision complaint for lack of fundamental significance and unification of jurisprudence under § 543 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the plaintiff's complaint against the non-admission of revision, upholding the appellate court's decision and dismissing the appeal for lack of fundamental legal significance or need for uniform jurisprudence. The dispute arose from a civil proceeding where the plaintiff challenged the 11th Civil Senate of the Higher Regional Court’s refusal to allow an appeal to the BGH. Relying on established case law regarding the requirements for admitting revision in such contexts, the BGH cited specific precedents concerning the development of the law and the unification of legal practice, finding that the plaintiff's arguments did not meet the threshold for exceptional review. The court ordered the plaintiff to bear the costs of the complaint proceedings, setting the subject matter value at up to €22,000.
