Drug trafficking in significant quantities: validity of "drug entered commerce" finding for lesser-offense assessment under § 46 Abs. 3 StGB
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Justice dismissed the defendant's appeal as unfounded, upholding the Landgericht Konstanz's conviction for drug trafficking in significant quantities and ordering the defendant to bear the costs of the legal proceedings. The case involved a challenge to the sentencing phase, specifically concerning the application of § 46 Abs. 3 StGB regarding the totality of circumstances, where the lower court’s finding that a significant portion of the marijuana had entered commerce due to the lack of seizure was deemed contextually adequate despite initial ambiguity. While the appellate court noted that the lower court's phrasing regarding the unseized drugs was questionable, it clarified that this formulation was intended only to distinguish this instance from a prior case involving self-consumption where the drugs were secured, leaving the original judgment intact.

Volltext
