Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice dismissed the attorney's complaint against the non-allowance of revision, thereby upholding the judgment of the 2nd Senate of the Attorney Court of North Rhine-Westphalia and ordering the appellant to bear the costs of the legal remedy. The dispute concerned an attorney disciplinary procedure where the lower court had denied the appeal on points of law; the appellant challenged this denial but failed to substantiate that the case involved a fundamental, abstract legal question or a question of professional duties not already resolved by law or precedent. The decisive legal basis for the dismissal was § 145 Abs. 3 Satz 3 BRAO, which requires the explicit designation of a legal question of general significance for the complaint to be admissible, as the appellant’s arguments pertained only to the application of law to the specific facts of the case rather than a reviewable legal principle.
