Qualification of computer fraud: use of incorrect data versus unauthorized use of data under § 263a Abs. 1 StGB
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (3rd Criminal Senate) dismissed the defendant's appeal as unfounded, leaving the conviction and sentence issued by the Landgericht Duisburg in force. The case involved a challenge to a conviction for computer fraud, specifically regarding the classification of the specific criminal conduct committed to the detriment of two banks. While the conviction was upheld, the court issued a clarifying remark correcting the legal characterization of the offense, determining that the facts established by the lower court's error-free assessment of evidence fulfilled the elements of using incorrect data (§ 263a para. 1 alternative 2 StGB) rather than the unauthorized use of data (§ 263a para. 1 alternative 3 StGB) alleged by the lower court.
