Legislator-Zusammenfassung

The Bundesgerichtshof (6th Criminal Senate) dismissed the co-accused's appeals, rejecting one as inadmissible under § 349 Abs. 1 StPO regarding the omission of a conviction for aggravated arson (§ 306b Abs. 2 Nr. 2 StGB) and the other as unfounded under § 349 Abs. 2 StPO, thereby upholding the Landgericht Göttingen's judgment of April 28, 2022; the appellate court ordered the appellants to bear the costs of their legal remedies and the necessary expenses incurred by the defendant. The dispute concerned the finality of a criminal trial where the co-accused challenged the lower court's decision not to convict the defendant on the specific charge of aggravated arson, arguing it was a material legal error. The decisive legal basis was the procedural threshold for admissibility of co-accused appeals under § 349 StPO, specifically distinguishing between inadmissible challenges to omitted charges and unfounded substantive objections to the existing verdict.
