Inadmissibility of legal appeal against dismissal of appeal for lack of fundamental legal significance and denial of legal aid
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) denied the defendant's application for legal aid to file a legal appeal (Rechtsbeschwerde) against a Munich Higher Regional Court decision and dismissed his motion to recuse a court officer, holding the defendant prevailed in neither request. The dispute involved a procedural challenge where the Higher Regional Court had dismissed the defendant's appeal as inadmissible, and the defendant subsequently sought legal aid for a further appeal and objected to a court officer's procedural notice. The Court ordered that the application for legal aid be refused and the recusal motion be dismissed as inadmissible. The decisive legal basis was that a legal appeal against a decision dismissing an appeal as inadmissible is only permissible if the case involves fundamental legal significance, requires the development of law, or ensures uniform jurisprudence under § 574(2) ZPO, none of which were met; additionally, the court officer's issuance of the disputed notice was deemed a fulfillment of official duties rather than a justifiable ground for recusal under §§ 10, 28 RPflG in conjunction with §§ 41 ff. ZPO.
