Requirements for mandatory counsel appointment: Substantiated approach to five Supreme Court lawyers and non-attributable mandate termination
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) rejected the application filed by the affected party in a protective custody proceeding, denying the appointment of a mandatory counsel (Notanwalt). The dispute centered on the requirement for mandatory legal representation, where the applicant had previously entrusted a lawyer who subsequently terminated the mandate. Applying § 10 Abs. 4 Satz 3 FamFG in conjunction with § 78b ZPO, the court held that the appointment of a mandatory counsel is only permissible if the participant substantiates having unsuccessfully approached at least five lawyers admitted to the Federal Court of Justice, or, in cases of prior termination, proves that the end of the mandate was not attributable to them. As the applicant failed to provide this substantive proof, the request for mandatory legal representation was dismissed.

Unterbringungssache: Beiordnung eines Notanwalts
[TENOR]
