Leasing dispute: Acte clair preclusion of suspension for EU preliminary reference on Directives 2002/65/EC
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Justice (BGH) dismissed the plaintiff's application to suspend proceedings and rejected his leave for appeal, thereby upholding the lower court's judgment. The dispute concerned a leasing agreement, where the plaintiff challenged the admission of a revision appeal, arguing that a pending preliminary reference to the European Court of Justice by another regional court on a related issue necessitated a suspension of the current proceedings. The BGH held that the plaintiff did not prevail, finding that the specific legal question raised in the preliminary reference regarding Directive 2002/65/EC was obvious under the doctrine of *acte clair*, rendering a suspension under § 148 ZPO unwarranted. The court further determined that the case lacked general significance and did not require further development of law or clarification of legal unity under § 543 (2) sentence 1 ZPO.

Januar 2020 - VIII ZR 80/18, BGHZ 224, 302 Rn. 51). Von einer weiteren Begründung wird gemäß § 544 Abs. 6 Satz 2 Halbs. 2 ZPO abgesehen.
Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
Der Gegenstandswert des Beschwerdeverfahrens beträgt bis 80.000 €.
