Necessity of Mandatory Defender's Travel Arriving Day Before Federal Supreme Court Hearing
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (5th Criminal Senate) granted the application, formally determining that the necessary travel expenses for the appointed defense counsel, including arrival on the day preceding the main hearing at the Leipzig location, were required, thereby affirming the counsel's entitlement to reimbursement. The dispute concerned the admissibility of a preliminary arrival by a mandatory public defender assigned to a criminal appeal proceeding, where counsel argued that traveling on the day of the hearing would necessitate an unreasonably early 5:30 AM departure from Hamburg. The court’s decision is based on § 46 Abs. 2 of the Professional Fees Regulation for Lawyers (RVG), which mandates the determination of the necessity of travel expenses, leaving the assessment of the specific amount of reasonable travel and accommodation costs to be decided during the final fee determination.
