Anhörungsrüge against non-admission complaint: waiver of reasoning under § 544(6) ZPO does not violate right to a hearing
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice’s 9th Civil Senate dismissed the defendant’s complaint regarding the denial of a hearing (Anhörungsrüge) against its earlier order rejecting a non-admission complaint, leaving the defendant to bear the costs. This procedural dispute arose from the defendant’s challenge to a prior appellate decision where the court declined to admit a revision (appeal on points of law) regarding an unspecified civil matter, alleging a violation of the right to be heard due to the lack of reasoning in the rejection order. The Senate held that the objection was unfounded, ruling that under § 544 Abs. 6 Satz 2 Halbsatz 2 ZPO, a detailed justification for the non-admission is not required if it would not contribute to clarifying the conditions for admitting a revision, and that the absence of such reasoning does not independently constitute a violation of the right to a hearing under § 321a ZPO or constitutional law.

Die Anhörungsrüge gegen den Senatsbeschluss vom 7. Juli 2022 wird auf Kosten des Beklagten zurückgewiesen.
[GRUENDE]
BT-Drucks. 15/3706 S. 16; BGH, Beschluss vom 24. Februar 2005 - III ZR 263/04, NJW 2005, 1432, 1433; vom 28. Juli 2005 - III ZR 443/04, NJW-RR 2006, 63, 64; vom 6. Oktober 2005 - IX ZR 120/03, juris; siehe ferner BGH, Beschluss vom 19. Januar 2004 - II ZR 108/02, WM 2004, 1894, 1895). BGH, Beschluss vom 28. Januar 2021 - I ZR 80/20, juris Rn. 2 f mwN).
