Effect of non-compliance with electronic filing format requirements in criminal appeals
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendant's appeal as unfounded, ordering him to bear the costs of the legal remedy and the necessary expenses of the co-plaintiff, thereby upholding the lower court’s judgment. The case concerned the procedural validity of a criminal appeal and its justification, which were submitted via the special electronic attorney mailbox (beA) in .docx format rather than the statutorily required PDF format under § 32a(2) sentence 2 StPO in conjunction with the Electronic Courts Act. The Court held that the deviation from the prescribed file format did not render the procedural declarations formally invalid because § 32a(2) sentence 1 StPO requires that electronic documents be merely "suitable for processing by the court," a substantive test that is not failed by purely formal violations if the court can still process the document; since the documents were readable and processable, the deadlines for filing and justifying the appeal were met, making a decision on the defendant’s precautionary request for restoration of the previous position unnecessary.

19/28399, S. 39 i.V.m. S. 33 f.; ferner BeckOK-StPO/Valerius, 44. Ed., § 32a Rn. 7; Radke in Ory/Weth, jurisPK-ERV, 2. Aufl., § 32a StPO Rn. 12). Letzteres ist hier jeweils der Fall.
