Confiscation order: Whether failure to tenor joint and several liability for unknown co-perpetrators precludes the defendant's defense of performance effects
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice's First Criminal Senate dismissed the defendant's appeal as unfounded, rejecting the prosecutor's proposed modification that would have specified joint and several liability in the confiscation order. The defendant challenged the lower court's conviction and the associated confiscation decree, raising issues concerning the non-tenoration of joint and several liability with unknown co-perpetrators. The court held that the failure to explicitly state joint and several liability did not prejudice the defendant, as the right to raise the defense of performance effects under § 422 Para. 1 Sentence 1 BGB remains available if unknown co-perpetrators are successfully pursued by the state. The dismissal was issued by order pursuant to § 349 Para. 2 StPO, as the prosecutor's conditional request to limit the dismissal did not preclude an unrestricted rejection of the appeal under § 349 Para. 4 StPO.

Volltext
April 2015 – 4 StR 69/15, 29. September 2010 – 4 StR 435/10; 23. Juli 1993 – 2 StR 346/93, BGHR StPO § 349 Abs. 2 Antrag 1; jeweils mwN).
