The German Federal Court of Criminal Court (4th Senate) dismissed the defendant's appeal as largely unfounded but modified the lower court's judgment by striking the order for the pre-execution of two years and six months of the prison sentence prior to the security measure. The dispute concerned a criminal case where the defendant challenged the sentence and accompanying security measures, specifically the pre-execution of part of the sentence. Relying on established case law regarding § 67 Abs. 2 Sätze 2, 3 StGB, the court held that such an order is legally void when the relevant period has already been fully served through pre-trial detention by the time of the decision, and thus the clause could not stand. The defendant was ordered to bear the full costs of the legal remedy, as the appeal was deemed only minimally successful.
