Legislator-Zusammenfassung

The plaintiff’s objection (interpreted as a complaint under § 66 GKG) against the Federal Court of Justice’s cost assessment is rejected, with the cost determination upheld as correct. The dispute concerns the procedural costs arising from a rejected *Anhörungsrüge* (complaint regarding a denial of the right to be heard), where the plaintiff’s initial objection against the prior decision was not accompanied by a separate application for legal aid. The court determined that the fixed fee for the summary review procedure under § 321a ZPO is calculated according to item 1700 of the Cost Tariff for Courts (KV GKG), not item 4500, as required by prior precedent for such applications without legal aid. The decision was issued free of court fees, and no reimbursement of out-of-court costs is granted pursuant to § 66 para. 8 GKG.

Volltext

Senatsbeschluss vom 28. Januar 2014, aaO).

Die Entscheidung ergeht gerichtsgebührenfrei. Außergerichtliche Kosten werden nicht erstattet (§ 66 Abs. 8 GKG).
