The German Federal Court of Civil Procedure dismissed the debtor's motion for hearing of argument (Anhörungsrüge) as inadmissible and ordered no costs, leaving the previous appellate decision of June 27, 2022, in force. The dispute arose in a bankruptcy insolvency proceeding where the debtor challenged the appellate court’s ruling without legal representation. The court held that the motion was procedurally invalid because the insolvency appeal stage is subject to mandatory representation by a lawyer, a requirement that extends to procedural motions such as the Anhörungsrüge. The decisive legal basis for the ruling included §§ 321a(1), 78(1) sentence 3 of the Code of Civil Procedure (ZPO) regarding the admissibility of the motion and mandatory counsel, and § 21(1) sentence 3 of the Court Costs Act (GKG) regarding the cost allocation.

Die Anhörungsrüge gegen den Senatsbeschluss vom 27. Juni 2022 wird als unzulässig verworfen. Kosten werden nicht erhoben.

[GRUENDE]

Juli 2021 - I ZB 28/21, juris Rn. 2 mwN).

2. Die Kostenentscheidung beruht auf § 21 Abs. 1 Satz 3 GKG.
