Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice dismissed the plaintiff's leap appeal (Sprungrechtsbeschwerde) as inadmissible, ordering the plaintiff to bear the costs, thereby leaving the lower court's procedural posture unchanged. The dispute involved a civil litigation matter where the plaintiff attempted to directly challenge a procedural notice order (Hinweisbeschluss) issued by the local court (Amtsgericht) to the supreme civil court, bypassing the regional higher court. The court held that under § 574(1) Sentence 1 ZPO, an appeal on points of law (Rechtsbeschwerde) against an order is only permissible if expressly provided by law or explicitly permitted by the appeal or higher regional court in the first instance, neither of which applied here. Consequently, no other legal remedy to the Federal Court of Justice was available against the procedural notice, and the only viable legal path is an appeal against the final decision of the local court should the statutory prerequisites be met.
