Insolvency-induced loss of litigation capacity as bar to non-admission of appeal
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Justice (BGH) denied the defendant's application for legal aid to file a complaint against the non-admission of appeal in a rental law dispute. The underlying case involved a dispute where the higher regional court had refused to admit an appeal to the BGH. The BGH held that the application was inadmissible because the defendant, a party to the original rental dispute, had lost the capacity to conduct legal proceedings following the opening of insolvency proceedings against them, which transferred the right to manage and dispose of their assets to the insolvency administrator. Consequently, the defendant could no longer pursue the case in the third instance. The court further noted that the defendant had failed to demonstrate any grounds for admitting the appeal under the relevant provisions of the Code of Civil Procedure, resulting in the mandatory refusal of legal aid.
