Denial of legal leave for revision in contract dispute: rejection of complaint against refusal to admit revision for lack of fundamental significance or procedural fundamental rights violations.
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint against the refusal to admit a revision appeal, thereby upholding the judgment of the Munich Higher Regional Court and leaving the lower court's decision in force, with the plaintiff ordered to bear the costs of the proceedings. The dispute concerned the plaintiff's attempt to challenge the appellate court's denial of legal leave for a subsequent revision, asserting both a lack of fundamental legal significance and violations of procedural fundamental rights. The BGH rejected the complaint based on § 543 Abs. 2 Satz 1 ZPO, finding that the case did not possess fundamental significance nor require further development of the law or uniform jurisprudence, and deemed the alleged procedural right violations non-substantive; the court abstained from providing a detailed reasoning under § 544 Abs. 6 Satz 2 Halbsatz 2 ZPO.
