Satisfaction of Prosecutor General’s request for conviction modification through dismissal of appeal under § 349 Abs. 2 StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendants' appeals as unfounded, upholding the Lower Court’s conviction for aggravated robbery in 316 counts and ordering each appellant to bear their own legal costs. The dispute centered on a challenge to the scope of the guilty verdict, where the Prosecutor General had requested a partial discontinuation of one count and a consequent modification of the judgment, although the Lower Court had already provisionally discontinued that specific count under § 154 Abs. 2 StPO and correctly excluded it from the count of 316 convictions. The court determined that no legal error to the defendants' detriment existed and that it was not precluded from resolving the appeal via a written order under § 349 Abs. 2 StPO despite the request for a modified judgment, as the overall outcome aligned with the prosecution's position, thereby leaving the original conviction in full force.
