Importation versus transit of narcotics in non-small quantity: driver’s stowed luggage accessible during transit
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Criminal Court (BGH) dismissed the defendant’s appeal as unfounded, upholding the lower court’s conviction and order that the defendant bear the costs of the appeal. The case concerned the defendant’s prosecution for the importation of narcotics in a non-small quantity, based on the discovery of over 4 kilograms of cocaine hidden in a suitcase stowed in the cargo hold of a long-distance bus traveling from Amsterdam to Vienna, which was stopped by authorities immediately after entering Germany. The court affirmed the legal classification of the act as importation rather than transit, ruling that the requisite condition for importation was met because the defendant personally stowed the luggage and retained the practical ability to access the drugs during any stop on the route, thereby satisfying the requirement that the narcotics actually became available to the perpetrator within the Federal Republic under § 30 Abs. 1 Nr. 4 StGB and § 29 Abs. 1 Satz 1 Nr. 5 BtMG.
