The Federal Court of Justice (BGH) dismissed the applicant's filings, proceeding against the decision of the Higher Regional Court of Hamburg, as inadmissible and rejected the request for the appointment of legal aid, leaving the lower court's ruling intact in favor of the respondent. The dispute involved an attempt to challenge a non-admission of a legal remedy (Rechtsbeschwerde) and a motion for an interim injunction, where the applicant also sought exemption from the mandatory representation by a lawyer. The BGH held that no statutory legal remedy was available under § 574 Abs. 1 Satz 1 Nr. 1 ZPO, no specific permission for the remedy was granted under § 574 Abs. 1 Satz 1 Nr. 2 ZPO, and the decision regarding the non-admission of the Rechtsbeschwerde is not subject to appeal. Consequently, the request for a public defender was denied due to the lack of reasonable prospects of success under § 78b Abs. 1 ZPO, and no legal basis existed for an exemption from the requirement of professional legal representation at the BGH level.

BGH, Beschluss vom 10. Juni 2024 - I ZB 30/24, juris, mwN).
