Objection to court cost assessment limited to violations of cost law
Legislator-Zusammenfassung
KI-generiertThe Bundesgerichtshof (BGH) rejected the defendant's objection against the court's cost assessment, upholding the fee charge. The dispute concerned a procedural cost challenge where the defendant sought to contest a 132 EUR fee levied following the BGH's rejection of his legal remedy against a lower court's dismissal of an immediate appeal as inadmissible. The court determined that the objection was procedurally valid but substantively unfounded, as it failed to allege any specific violation of cost law, which is the exclusive basis for such objections. Relying on § 66 GKG and § 22, § 29 No. 1 GKG, the BGH confirmed that the fee was correctly assessed under Item 1826 of the Cost Schedule for the rejection of a non-admitted legal complaint, affirming the defendant's status as the party liable for the decision.

[GRUENDE]
