Mandatory joinder of law firm liquidator in appeal against fixed liquidation fees
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) ordered the mandatory joinder of the law firm liquidator as a party to the ongoing appeal proceedings. The case involves a lawyer challenging the remuneration fixed by the Bar Association for the liquidation of his law firm, where the Regional Bar Court had previously dismissed the initial lawsuit and the BGH subsequently admitted the appeal based on a procedural error and doubts about the first-instance judgment. The court held that under the interplay of the Federal Lawyers Act (BRAO) and the Administrative Procedure Act (VwGO), the liquidator must be joined when their remuneration is contested, as they are directly affected in their legal interests and the fees can only be determined jointly for the firm holder and the liquidator; this joinder is permissible even at the appellate stage. The decision is final and unchallengeable.

Beiladung eines Kanzleiabwicklers bei Anfechtung einer Abwicklervergütung
[TENOR]
Gemäß § 65 Abs. 2 VwGO (i.V.m. § 112e Satz 2 BRAO, § 125 Abs. 1 Satz 1 VwGO) wird zum Verfahren beigeladen:
Rechtsanwalt R. H. , W. , N. .
[GRUENDE]
Aufl., § 65 VwGO, § 125 VwGO Rn. 5; W.-R. Schenke in Kopp/Schenke, VwGO, 29. Aufl., § 65 Rn. 4). Für die Beiladung ist nach §§ 112e Satz 2 BRAO, § 125 Abs. 1 Satz 1, § 87a Abs. 1 Nr. 6, Abs. 3 VwGO der Berichterstatter zuständig.
III.
IV. Dieser Beschluss ist unanfechtbar.
