The Federal Court of Justice (BGH) dismissed the defendant's revision as unfounded, affirming the Landgericht Münster's conviction and sentence while ordering the defendant to bear the costs of the appellate proceedings and the ancillary party's necessary outlays. The dispute involved a criminal appeal challenging the legality of the original judgment, with the appellate court conducting a supplementary review of the sentencing logic. Although the lower court erroneously penalized the defendant for failing to provide "effective help" to the victim post-offense—a conduct that should have been considered as a mitigating factor under established case law rather than used to aggravate the sentence—the BGH held that this legal error did not warrant a new trial, concluding that the remaining aggravating circumstances would have led the lower court to impose the same or a harsher penalty regardless. The decision relies on § 349 Abs. 2 StPO for the dismissal standard and prior BGH jurisprudence regarding the incorrect handling of post-offense assistance as a sentencing factor.

Basis for dismissing the revision as unfounded because the review did not reveal a legal error to the detriment of the accused.

Volltext
