The Federal Court of Justice (5th Criminal Senate) dismissed the defendant’s appeal as unfounded, upholding the Landgericht Berlin’s conviction and ordering the defendant to bear the costs of the legal proceedings and the ancillary costs for the incidental plaintiff. The dispute centered on a procedural objection that the defendant lacked criminal capacity due to being only 14 years old at the time of the offense. The court determined that this procedural hindrance did not exist, noting that the trial court had properly determined the defendant's age through a strict evidence procedure during the main hearing and had adequately addressed defense objections. The decisive legal basis rests on the doctrine that age is a "doppelrelevante Tatsache" (dual-relevance fact) serving as both a condition for criminal liability and a prerequisite for the application of substantive law; consequently, the appellate court is bound by the lower court’s fact-finding regarding this age determination, provided it is based on a legally correct evaluation of evidence, rendering the procedural complaint inadmissible.

Volltext

Januar 2013 – 4 StR 380/12, NStZ 2013, 290; vom 11. Januar 2000 – 1 StR 633/99, NStZ 2000, 388). Eine zulässige Verfahrensrüge ist insoweit nicht erhoben.
