The Federal Court of Justice (BGH) dismissed the applicant’s motion for leave to appeal as inadmissible, resulting in the lower court's decision upholding the revocation of the applicant's legal professional license remaining in force; the applicant was ordered to bear the costs of the proceedings, and the dispute value was fixed at €50,000. The dispute concerned the revocation of an attorney's license to practice law due to insolvency or financial decline (Vermögensverfall) under § 14 Abs. 2 Nr. 7 of the Federal Lawyers' Act (BRAO), which the Regional Administrative Court (Anwaltsgerichtshof) of North Rhine-Westphalia had affirmed in a judgment served in December 2023. The decisive legal basis for the dismissal was the procedural requirement that a motion for leave to appeal must be substantiated within two months of service of the judgment, pursuant to § 112e Satz 2 BRAO in conjunction with §§ 124a Abs. 4 Satz 4 and 125 Abs. 2 Satz 1 VwGO; as no justification was filed before the deadline expired, the application was deemed unadmissible without examination of the substantive merits.

[GRUENDE]
