Unlawful narcotics import: Admissibility of negligence-based aggravation for quantity exceeding conditional intent in sentencing
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH), 4th Criminal Senate, rejected the defendant's revision as unfounded, upholding the Landgericht Dortmund's conviction and sentencing for the unlawful import of narcotics in a significant quantity, leaving the lower court's judgment in force. The case challenged whether the trial court erred in aggravating the punishment by attributing a negligence-based culpability to the defendant for failing to verify the type of goods he imported, a factor the appellate court identified as legally problematic because it described a negligence offense that was not admissible for guilt-increasing consideration under the specific circumstances. The decisive legal basis centered on the distinction between intentional fault (Vorsatz) and negligence (Fahrlässigkeit) in sentencing, where the BGH ruled that although a surplus quantity beyond intent could be considered if negligence was proven, the established findings indicated the defendant had dolus eventualis (conditional intent) for the entire transported quantity, thereby excluding a negligence charge; however, the court concluded that this legal error was non-impactful (non-ertragsfähig) because the individual sentences imposed were moderate enough that the overall result would not have changed.

BGH, Urteil vom 12. September 2019 ‒ 5 StR 325/19, Rn. 13; Urteil vom 10. Februar 2011 ‒ 4 StR 576/10, Rn. 9; Urteil vom 6. September 1995 ‒ 2 StR 310/95, StV 1996, 90; Urteil vom 21. April 2004 ‒ 1 StR 522/03, Rn. 13).
