Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the plaintiff's application for leave to appeal as inadmissible, ordering the plaintiff to bear the costs of the proceedings; this decision upholds the lower court's judgment upholding the administrative authority's revocation of the plaintiff's license to practice law. The dispute arose after the authority revoked the plaintiff's admission to the bar due to financial ruin (*Vermögensverfall*), a decision the plaintiff challenged unsuccessfully in the first-instance Attorney Court, which dismissed the claim as unfounded. The definitive legal basis for the dismissal was the plaintiff's failure to comply with procedural requirements under § 112e Sentence 2 BRAO in conjunction with §§ 124a(4) Sentence 4 and 125(2) Sentence 1 VwGO, specifically by missing the two-month deadline to substantiate the application for leave to appeal, which expired without the filing of any grounds.
