Jurisdiction for further complaint against regional court's rejection of search order objection lies with higher regional court
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) referred the case to the Oberlandesgericht Saarbrücken for decision in its own jurisdiction, effectively ruling that the BGH was not the proper appellate forum for the applicant's challenge. The dispute concerned a further complaint (further Beschwerde) against a regional court's rejection of an objection to a search and seizure order issued by a local court, where the applicant sought to overturn the decision to deny relief against the investigative measure. The court held that under § 121 Abs. 1 Nr. 2 GVG, jurisdiction for further complaints against decisions of regional courts lies with the higher regional court, and that no legal appeal under § 29 EGGVG was available; consequently, the BGH 2nd Criminal Senate determined that the Oberlandesgericht Saarbrücken must resolve the complaint, leaving the original search order and the subsequent procedural rulings in force pending that higher court's decision.
