Statute of limitations for concurrent pornographic distribution in sexual abuse cases and statutory minimum sentencing
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) 1st Criminal Senate rejected the defendant's revision as unfounded, but modified the judgment to correct the legal characterization and sentencing, leaving the total custodial sentence of seven years and nine months unchanged. The defendant, convicted for extensive sexual abuse of children (339 cases) and aggravated sexual abuse (3 cases), challenged the Landgericht Augsburg's verdict; the dispute centered on the concurrence of offenses and statutory limitations. The court held that the concurrent conviction for distribution of pornographic material expired due to the statute of limitations (§§ 78(3) No. 5, 78a Sentence 1 StGB), necessitating the removal of that charge and reducing the corresponding individual sentences from four to three months based on the statutory minimum for sexual abuse of children (§ 176(4) No. 4 StGB aF). Additionally, six individual ten-month sentences were removed due to changes in the count of individual acts, but the total sentence was sustained as justified by the remaining base sentences under § 354(1) StPO applied by analogy.

a) der Angeklagte schuldig ist des versuchten schweren sexuellen Missbrauchs von Kindern in Tateinheit mit sexuellem Missbrauch von Kindern, des schweren sexuellen Missbrauchs von Kindern in drei Fällen sowie des sexuellen Missbrauchs von Kindern in 335 Fällen; die tateinheitliche Verurteilung wegen Verbreitung pornografischer Schriften in den Fällen B.I.1. und B.II.4. der Urteilsgründe entfällt;
