Anhörungsrüge against summary dismissal of criminal appeal: no duty to reason under § 349 Abs. 2 StPO
Legislator-Zusammenfassung
KI-generiertThe 2nd Criminal Senate of the Federal Court of Justice dismissed the defendant's complaint for lack of a hearing (Anhörungsrüge) as unfounded and awarded costs against him. The defendant, who had been convicted, challenged the Senate's order rejecting his appeal on points of law as a violation of formal and substantive law, alleging that the court had failed to consider his arguments or adequately explain the rejection of his procedural objections. The court held that no hearing deficit occurred, as the Senate had deliberated comprehensively and decided via order, and clarified that § 349 Abs. 2 StPO does not require a reasoned decision for appeals dismissed as unfounded, nor is such reasoning constitutionally mandated; the reference to the General Public Prosecutor’s submission did not constitute a disregard of the defendant's submissions. The decisive legal basis comprised § 356a StPO for the complaint, § 349 Abs. 2 StPO for the dismissal of the appeal, and § 465 Abs. 1 StPO applied mutatis mutandis for the cost award.

BGH, Beschluss vom 5. Mai 2014 – 1 StR 82/14, juris Rn. 9).
