Non-admission of revision in civil litigation: fundamental significance and uniform jurisprudence under § 543 Abs. 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the complaints for non-admission of revision filed by both the plaintiff and the defendant, leaving the decision of the Oberlandesgericht Dresden from December 15, 2022, in force. The dispute concerned a civil litigation proceeding involving multiple claims and a counterclaim, with the specific subject matter identified by the case value allocation of 90,400 EUR across various requests, including limited and unrestricted amounts. The court determined that the legal issues raised did not possess fundamental significance, nor was an appellate decision necessary for the development of law or to ensure uniform jurisprudence under Section 543(2) of the Code of Civil Procedure (ZPO). Consequently, the appellant and respondent were required to bear the costs of the complaint proceedings in the ratio of 83% and 17%, respectively, with specific case values assigned to each party's individual complaint and the underlying counterclaim.
