Legislator-Zusammenfassung

KI-generiert

The Federal Cartel Senate ordered the dismissal and termination of both the appellate and legal review proceedings, deeming them as never having become pending, and declared the lower court's decision of 16 March 2022 null and void; the applicant prevailed procedurally by withdrawing the complaint, though it was ordered to bear the costs of both proceedings and necessary expenses of the regulatory authority, with the subject value of the legal review set at €250,000. The case involved a dispute under the Energy Market Act (EnWG) where the applicant challenged a regulatory decision by the Federal Network Agency, leading to a procedural resolution without a substantive adjudication on the merits of the underlying antitrust or energy market issue. The decisive legal basis included the doctrine that a withdrawal of complaint in agreement with the opposing party renders the proceedings as not pending, alongside cost allocation rules under § 90 Sentence 1 EnWG and value determination norms under § 50 Abs. 1 Sentence 1 No. 2 GKG and § 3 ZPO.
