Admissibility of appellate complaint under Regulation (EC) No. 715/2007: failure to demonstrate fundamental significance of legal questions
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice dismissed the plaintiff's complaint against the refusal to admit appeal to the revising court, thereby rejecting the appeal and upholding the lower court's decision; the plaintiff bore the costs of the complaint proceedings. The dispute arose from proceedings concerning the legal interpretation and application of Art. 3 Nr. 10 of Regulation (EC) No. 715/2007. The court determined that the appeal did not meet the threshold for admission because the plaintiff failed to sufficiently demonstrate that the legal questions raised were of fundamental significance for the purposes of § 543 Abs. 2 Satz 1 Nr. 1 ZPO, specifically regarding the relevance of the conditions stipulated in the cited EU regulation.
