The German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the judgment of the Düsseldorf Higher Regional Court and leaving the lower court's decision in force, with the plaintiff ordered to bear the costs of the complaint proceedings and the disputed value assessed at approximately 10.4 million euros. The dispute concerned a civil matter where the plaintiff challenged the procedural refusal to admit an appeal to the highest court, arguing that the case possessed fundamental legal significance or required the development of law to ensure uniform jurisprudence. Applying Section 543(2) Sentence 1 of the Code of Civil Procedure (ZPO), the BGH determined that the legal issues raised did not exhibit the necessary fundamental importance or require a decision on the merits to develop the law or secure consistent legal interpretation, rendering a detailed reasoning unnecessary under Section 544(6) Sentence 2 ZPO.
