Scope of appeal under § 349(2) StPO and interpretation of unannounced appellate motions despite prosecution's assumption of restricted review
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Reference (BGH) dismissed the defendant's appeal as unfounded, confirming the lower court's conviction for murder in concurrent perpetration with attempted murder and grievous bodily injury, and ordering the defendant to bear the procedural costs and the victims' necessary expenses. The dispute centered on a procedural ambiguity where the prosecution, in its application for dismissal, mistakenly assumed the appeal was restricted to the sentencing portion based on the appellate attorney's conduct, despite the defendant's filed brief containing an unlimited motion for annulment. The court held that an appellate motion must be interpreted as covering the most extensive grounds for review in doubt, and that the appellate court is not bound by the prosecution's erroneous characterization of the scope when deciding under Section 349(2) of the Code of Criminal Procedure; this provision allows for a decision without an oral hearing if both the prosecution and the court independently conclude the appeal is manifestly unfounded, a standard met here as the guilty verdict and evidence were legally sound.
