The German Federal Court of Civil Justice dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the appellate court's decision to deny the admissibility of appeal and leaving the lower instance judgment final against the plaintiff, who bears the costs of the proceedings. The dispute concerned a tort claim under § 823(2) BGB in conjunction with the EU General Food Law, where the plaintiff alleged a violation regarding a defective product, but the court found that the complaint failed to demonstrate the decisive relevance of the legal issues because the defendant was a motor manufacturer rather than the vehicle manufacturer itself, and the plaintiff had not sufficiently substantiated an intentional violation of law by the vehicle manufacturer in which the motor manufacturer would have participated. The decision was grounded in §§ 543(2) and 544(6) ZPO, specifically requiring the applicant to establish that the legal question has fundamental significance or requires the development of law or uniform jurisprudence.

Primary legal basis for dismissing the non-admission complaint because the case lacked fundamental significance or a need for the development of law.

§ 544 Abs. 6 Satz 2 Halbsatz 2 ZPO

Procedural rule allowing the court to omit a further written reasoning as it would not contribute to clarifying the conditions for admitting a revision.

§ 97 Abs. 1 ZPO

Basis for ordering the unsuccessful plaintiff to bear the costs of the complaint proceedings.
