Recusal after instance closure and hearing complaint requiring legal representation
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH), 9th Civil Senate, dismissed the plaintiff's motion for recusal and his subsequent hearing complaint and counter-representation as inadmissible, leaving the prior appellate court decision of July 4, 2023, in force. The dispute arose within a legal appeal procedure where the plaintiff sought to challenge the composition of the appellate bench after the instance had concluded, and later filed a hearing complaint alleging that his arguments were ignored, along with a counter-representation against the appellate court’s decision. The court held that a recusal motion is inadmissible once a judicial instance is finally concluded because the judges have ceased their activity and the decision is no longer alterable by that court; consequently, a preliminary hearing complaint cannot revive the expired right to recusal. Additionally, the hearing complaint and counter-representation were rejected for lack of mandatory legal representation by an attorney admitted to the BGH and because they were fundamentally misguided, as the plaintiff merely contested the legal assessment of his case rather than alleging a valid violation of his right to be heard.

Zulässigkeit eines Ablehnungsgesuchs nach Abschluss einer Instanz; Zulässigkeit einer Anhörungsrüge vor BGH
[TENOR]
August 2016 - I ZB 10/15, juris Rn. 4).
BGH, Beschluss vom 29. Mai 2013 - IX ZB 7/13, juris Rn. 3; vom 30. August 2016 - I ZB 10/15, juris Rn. 5; vom 1. Dezember 2021 - IX ZR 220/20). BGH, Beschluss vom 17. Mai 2018 - I ZR 195/15, NJW-RR 2018, 1461 Rn. 6).
